1. Agreement to Terms

By accessing or using GSTPro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, visitors, and others who access or use the Service.

2. Description of Service

GSTPro is a software service that helps users create and send goodwill letters to creditors requesting the removal of late payment records from credit reports. The Service provides:

• AI-powered letter generation using natural language processing
• A database of creditor addresses for major financial institutions
• Physical mail sending through third-party mail service providers
• Campaign management and response tracking tools

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 18 years old to use this Service. By using the Service, you represent that you are at least 18 years of age.

5. User Responsibilities

You agree to:

• Provide truthful information about your account history with creditors
• Review all generated letters before sending and confirm their accuracy
• Use the Service only for legitimate goodwill requests (not disputes of valid debts)
• Not use the Service for any unlawful purpose or to violate any laws
• Not attempt to abuse, harass, or defraud creditors
• Not impersonate any person or entity
• Not interfere with or disrupt the Service or its infrastructure

6. Fees and Payment

6.1 Subscription Fees

The Service offers subscription plans with monthly fees. Current pricing is displayed on our website. By subscribing, you agree to pay the applicable subscription fees.

6.2 Mail Credits

Physical mail sending requires mail credits, which can be purchased separately or included with certain subscription plans. Credits are non-refundable once purchased.

6.3 Billing

Subscription fees are billed in advance on a monthly basis. You authorize us to charge your payment method for the applicable fees. All payments are processed through Stripe and subject to Stripe's terms of service.

7. Refund Policy

Due to the nature of the Service:

• Subscription fees may be refunded within 7 days of purchase if you have not generated any letters
• Mail credits are non-refundable once purchased
• Sent mail cannot be refunded or recalled once submitted to our mail provider

8. Intellectual Property

The Service and its original content, features, and functionality are owned by GSTPro and are protected by international copyright, trademark, and other intellectual property laws.

Letters generated using the Service are created for your personal use. You own the rights to letters you generate, but you grant us a license to use anonymized versions for improving our AI models.

9. Third-Party Services

The Service integrates with third-party services including:

• Lob - For printing and mailing physical letters
• Stripe - For payment processing
• Supabase - For authentication and data storage
• Anthropic - For AI letter generation

Your use of these services is subject to their respective terms of service. We are not responsible for the actions or policies of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GSTPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill
• Failure to achieve desired credit score improvements
• Decisions made by creditors regarding your requests
• Service interruptions or errors

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify and hold harmless GSTPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or abusive behavior
• Non-payment of fees
• Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within the United States for the resolution of any disputes.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, you agree to binding arbitration administered by a recognized arbitration association, except that either party may seek injunctive relief in court for intellectual property matters.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GSTPro regarding the Service and supersede all prior agreements and understandings.
